Terms of Use
Version 1.0 (20 Oct 2026). Operator: [LEGAL ENTITY NAME, e.g. TULIR Health Intelligence Private Limited], [REGISTERED ADDRESS], India ("we", "us"). Contact: [EMAIL].
These terms are a draft and must be reviewed by a qualified lawyer before Lucira is offered commercially.
The most important term. Lucira's outputs are AI (artificial intelligence) generated decision support only. They are not a diagnosis, not a treatment recommendation and not a medical opinion. No final diagnosis or treatment decision may be made on the basis of Lucira's outputs alone. Every finding must be verified by the treating doctor's own clinical assessment and appropriate investigations. The treating doctor remains solely responsible for all clinical decisions and patient care.
1. Who may use Lucira
- Lucira is only for qualified medical and dental practitioners who hold current registration or a licence to practise in a country where we offer the service (currently: [India]). It is not for patients or the public.
- Lucira Learn is a separate education service, open worldwide, for medical and dental students, interns, postgraduate aspirants and graduates preparing for licensing examinations whose details we have checked. Clinical use of Lucira for real patients remains limited to registered practitioners in the countries we list. It gives practice on teaching cases only. Lucira Learn accounts cannot run assessments on real patients, and you must not use Lucira Learn feedback to make or influence decisions about any real patient's diagnosis or treatment. Learn plans are personal and give access for the period paid; unused time is not refunded except where the law requires.
- One person, one account. Every account, doctor or student, is for the named person only. You must not share your login or let anyone else use your account. We limit how many devices can be signed in at once, review signs of sharing, and may suspend or close accounts that are shared or registered with false or borrowed documents.
- You must be at least 18 years old, use Lucira only in your professional capacity, and keep your account to yourself. Sharing an account is not permitted.
- By creating an account you confirm the declarations shown at sign-up. We record the date, time and version of your acceptance.
2. What Lucira is, and is not
- Intended use. Lucira is intended to inform a registered medical or dental practitioner's clinical management by presenting differential diagnoses to consider, findings to review and missing information, with the supporting evidence, for the practitioner's independent review. It is not intended to make a diagnosis, to triage patients, or to be used in place of the practitioner's own assessment of the complete study and the patient. Before each assessment you record your own working impression, and you mark each differential diagnosis as confirmed, ruled out or still being checked.
- Medicines. Lucira does not prescribe. Where it mentions medicines, it does so only as general, class-level information or as a possible cause of the presentation for you to check, without doses or a choice for the individual patient. Every decision to start, stop, continue or change a medicine, and every dose, is the treating practitioner's own clinical decision and responsibility, made with the current guideline and formulary.
- Lucira is clinical decision-support software. It has not been licensed, approved or cleared by CDSCO (Central Drugs Standard Control Organisation) or by any other regulator in any country.
- Do not use Lucira for emergencies or triage, for a final read of CT (computed tomography) or MRI (magnetic resonance imaging), or without the full study and your own examination. Lucira's output is for the treating doctor only and is not a report for the patient or the medical record. Use "Report a dangerous error" in the app to tell us about any output that could harm a patient.
- Outputs may be incomplete, inaccurate or inappropriate for a particular patient. They are produced from a small number of images and the information you enter, cannot account for anything not supplied, and are not designed for definitive interpretation of complex studies such as CT (computed tomography) or MRI (magnetic resonance imaging).
- Lucira does not replace a radiologist's, pathologist's or specialist's report, a full clinical examination, or established clinical guidelines.
- Lucira must not be used for emergencies or as the basis for urgent decisions. "Critical alert" messages are prompts to check, not a substitute for clinical vigilance.
3. Your responsibilities
- You will independently verify every output before acting, and document your own clinical reasoning.
- You will enter only de-identified data: no patient names, phone numbers, ID or hospital numbers, addresses, dates of birth, face photographs, or images with burned-in identifiers.
- You are responsible for obtaining any consent required by law or your institution for using de-identified clinical information in this way.
- You will comply with the laws, professional codes and guidelines that apply to you, including telemedicine and data-protection rules in your country.
- You will not use Lucira to provide services directly to patients without a doctor's oversight, to train competing products, or in any unlawful way.
4. No warranty
Lucira is provided "as is" and "as available". To the fullest extent permitted by law we make no warranty of any kind, express or implied, including accuracy, completeness, fitness for a particular purpose, or uninterrupted or error-free operation. The service may be unavailable during maintenance or outages.
5. Exclusion of liability
- To the fullest extent permitted by law, we accept no liability of any kind for any clinical decision, diagnosis, treatment or patient outcome, or for any direct, indirect, incidental, special or consequential loss or damage, arising from or connected with the use of, or inability to use, Lucira or its outputs.
- All clinical responsibility rests with the treating doctor, who uses Lucira at their own risk.
- Nothing in these terms excludes liability that cannot lawfully be excluded.
6. Indemnity
You agree to indemnify us against claims, losses and costs arising from your clinical decisions, your breach of these terms, or your entry of identifiable patient information.
7. Subscriptions and payment
- Plans, allowances and prices are shown in the app and may change for future purchases. Payment is by UPI (Unified Payments Interface) and is activated once verified. Plans do not renew automatically.
- Refunds: [REFUND POLICY]. Taxes: prices [include / exclude] GST (Goods and Services Tax).
- We may suspend or end an account that breaches these terms, including account sharing, without refund of the current period.
8. Data and privacy
How we handle data is described in the Privacy Policy, which forms part of these terms. Images sent for AI assessment are not stored. Images sent for a specialist read are stored encrypted until they are deleted under the retention period in the Privacy Policy. Saved cases are visible to you and the Lucira administrator.
8A. Specialist reads
- A specialist read is an opinion from an independent registered medical practitioner, given to you as the treating doctor, based only on the images and information you supply. It is advice to you, not a consultation with the patient, and does not replace your own assessment.
- You remain solely responsible for the patient's diagnosis and treatment. Use the urgency the specialist indicates as guidance only; for emergencies, act without waiting for a report.
- You must send only de-identified material and have the patient's consent to share it with a specialist for an opinion.
- The target report time shown in the app is a target, not a guarantee. If no specialist is available, we may cancel the request and refund the fee.
- Refunds for specialist reads: [REFUND POLICY FOR SPECIALIST READS].
9. Availability by region
Lucira is offered only in the countries listed in section 1. You must not use it to support care in other jurisdictions, where different medical-device and data-protection laws may apply.
10. Changes to these terms
We may update these terms. When we do, you will be asked to accept the new version before running further assessments.
11. Governing law
These terms are governed by the laws of India. The courts at [Chennai, Tamil Nadu] have exclusive jurisdiction.
